Terms Of Service

Definitions:


  1. These Terms of Service govern the relationship between Deblaria ("Artist") and the Client who commissions artwork. By engaging the Artist's services, the Client agrees to these terms.

  2. Commission - Commission is a request for a custom piece of artwork or design created by an artist for a specified fee. The client provides specific guidelines or themes for the artwork, and the artist produces a unique piece based on those instructions.

  3. WIP - WIP, or Work in Progress, refers to an incomplete piece of artwork that an artist is currently developing. These pieces will be shared with the client to provide insight into the artistic process or to receive feedback before finalization.

  4. OC - An abbreviation from Original Character is a unique fictional character created by an individual, distinct from existing characters in established media. OCs are often used in storytelling, role-playing, or as part of artwork and are defined by their own traits, backstories, and designs.

  5. Custom - A custom design is a tailored artwork or concept created specifically to meet a client's requirements. This can include character designs, illustrations, logos, or any other form of visual art that reflects the client's vision and specifications.

  6. Adoptables - Adoptables are original character designs that an artist creates and offers for sale or trade. Buyers can "adopt" these characters, gaining ownership of the design and the right to use them in various ways, such as in personal stories, role-playing, or artwork. Adoptables are often presented with a unique backstory and personality.

  7. YCH - An abbreviation from "Your Character Here", a type of artwork where a template containing a theme, poses, background or different features is already pre-defined, leaving space for a buyer to insert their own original character (OC).

General Rules


  1. Age Requirements: Clients must be at least 13 years old to commission me. If the client is underage, permission from a parent or legal guardian is required. Clients must be at least 18 to request NSFW artwork.

  2. Right to Refuse: I reserve the right to decline any commission without providing a reason.

  3. Availability: I do not work on weekends or holidays.

  4. Health and Well-being: Clients are encouraged to understand that the artist may take breaks for personal health and well-being, which may affect turnaround times.

  5. Social Media Sharing: Commissioned artwork may be shared on my social media. If you prefer that your commission not be shared publicly, please let me know when placing your order.

  6. Cancellation Policy: If a commission is canceled at the sketch stage, I may use it for other projects or as personal art.

  7. Credit: When posting my artwork, please credit me by my nickname: Deblaria and/or Lunar Creatures.

  8. Competition Use: Clients are not allowed to enter my artwork into any competitions.

  9. Profit Restrictions: Clients cannot profit from my artwork in any way.

  10. Editing: Clients may make slight edits to the commissioned artwork, but my signature must remain visible.

  11. NFT and AI Policy: I do not support NFTs or AI, and my artwork cannot be used for these purposes.

  12. Respectful Communication: Clients should maintain respectful communication at all times. Inappropriate language or behavior will not be tolerated.

  13. Client Responsibility: Clients are responsible for ensuring that all references and details provided for their commission are accurate and appropriate.

  14. Rule Enforcement: Violating any of these rules will result in being blacklisted; more serious violations may lead to further action.

Payment and Refunds


General:

  1. Payment Methods: International payments are accepted exclusively through PayPal (in US Dollars or Euro). Bank transfers are only available for banks of Poland (PLN) and Great Britain (GBP).

  2. Pricing: The prices listed are non-negotiable. (Doesn't apply for now)

  3. Transfer Fees: The client is responsible for any transfer fees associated with payments. Please ensure that the total amount received covers the agreed-upon fee without deductions.

  4. Currency Conversion: Clients should be aware of potential currency conversion fees when paying in a currency different from their own.

  5. Price Changes: Prices are subject to change, but clients who have already commissioned work will be honored at the rate agreed upon at the time of the order.

  6. Additional Costs: Any special requests, rush orders, or extensive revisions may incur additional costs, which will be communicated and agreed upon prior to starting the work.


Refunds:

  1. Refund Policy: Refunds are only available at the sketch stage. No refunds will be issued once the artwork is beyond this point.

  2. Artist-Initiated Refunds: In certain situations, a refund may be offered by the artist even after the sketch stage.

  3. Non-Refundable Items: Any additional fees for rush orders, special requests, or extra revisions are non-refundable.

  4. Chargebacks: Clients are encouraged to communicate directly regarding any issues. Initiating a chargeback without prior communication may result in being blacklisted from future commissions.

  5. Payment Method for Refunds: Refunds will be processed through the same payment method used for the original transaction.


Payment Plan:

  1. Payment Plans: Payment plans may be available; clients are encouraged to inquire for details.

  2. Late Payment Policy: Late payments may result in delays in delivering the artwork or its cancellation.

  3. Payment Schedule: Clients will receive a clear payment schedule outlining due dates for each installment.

  4. Communication on Payment Issues: Clients are encouraged to communicate any potential issues with meeting payment deadlines as soon as possible to discuss possible solutions.

  5. Consequences of Non-Payment: Failure to adhere to the payment plan may result in being blacklisted from future commissions.

Process and Revisions


  1. Progress Updates: Work-in-progress (WIP) images will be provided to the client after each stage of the project, as well as after any corrections have been made.

  2. Change Requests: Clients can request significant changes—such as alterations to clothing, expressions, poses, or backgrounds—only during the sketch stage. After the sketch is approved, any major changes will be evaluated and priced accordingly.

  3. Small Changes: Small changes or adjustments can be requested at any stage and will be made at no additional charge, provided they do not significantly alter the original concept.

  4. Revisions: Minor adjustments can be made after the sketch stage at no additional charge, but these should be communicated clearly.

  5. Client Response Requirement: If there is no response from the client regarding the WIP images within 2 days, work on the project will continue without the possibility of making free revisions.

  6. File Retention: Finished work files will be deleted a week after delivery. Clients are encouraged to save their final artwork promptly.

  7. Final Approval: Once the artwork is completed and delivered, final approval from the client is required. Any further changes requested after this approval may incur additional costs.

Adoptables and Customs


Adoptables:

  1. Credit to Artists: Purchasers must always credit the original artists and designers when sharing or displaying the character.

  2. Refund Policy: All sales are final; no refunds will be issued.

  3. Reselling Characters: Clients may not resell characters purchased from me at a higher price without including additional artwork or value.

  4. Design Edits: Clients can make minor edits to my designs but must continue to credit me as the original designer.

  5. Auction Bids: Once a bid is placed in an auction, clients cannot withdraw or pass on that bid.

  6. Refusal of Sale: The sale of designs can be refused without explanation at the artist's discretion.

  7. Age Restrictions: Clients must be at least 18 years old to adopt characters that include any NSFW artwork.

  8. Prohibition of Inappropriate Content: Sexualizing any minor or feral characters is strictly prohibited. Creating NSFW artwork of these characters will result in immediate reporting and being blacklisted from all platforms.

  9. Usage Rights: Clients receive personal use rights for the adopted characters. Commercial use or profit generation from the character design requires prior permission.


Customs:

  1. Commission Details: Clients must provide clear and detailed descriptions of their desired design, including references, specific features, and any other relevant information.

  2. Concept Approval: A preliminary sketch or concept will be provided for client approval before moving on to the final design. Significant changes can be requested at this stage.

  3. Payment: Full payment is required upfront before the final design is completed.

  4. Turnaround Time: Estimated completion times will be communicated based on current workload. Clients should allow for flexibility, as delays may occur.

  5. Communication: Clients are encouraged to communicate any preferences or ideas during the design process. Regular updates will be provided.

  6. Ownership Rights: Clients will have personal use rights for the custom design. Commercial use or reproduction of the design requires explicit permission.

  7. Final Approval: Once the design is completed, the client must give final approval before the artwork is delivered. Any requests for changes after this point may incur additional costs.

  8. Credit Requirement: When sharing or displaying the final design, clients must credit the designer.

  9. Non-Refundable Policy: All custom design orders are final; no refunds will be issued once the project has started.
